S&#039;inclouen tamb\u00e9 com a accidents d&#039;aquest tipus aquells anomenats in itinere, \u00e9s a dir, els soferts durant el trajecte \u201cdirecte\u201d de casa seva a la feina o viceversa, amb independ\u00e8ncia del temps que duri; \u00e9s a dir que poden existir accidents dues hores abans o despr\u00e9s de la feina i alguns que es produeixin als quinze minuts no es consideren ja que hi ha hagut una interrupci\u00f3 en el trajecte. En aquests darrers la indemnitzaci\u00f3 est\u00e0 subjecta a les mateixes exig\u00e8ncies que els accidents de tr\u00e0nsit, de manera que la indemnitzaci\u00f3 nom\u00e9s ser\u00e0 possible quan el lesionat no sigui culpable de l&#039;accident.<\/p>\n<p>S&#039;ent\u00e9n tamb\u00e9 com a accident professional a les lesions corporals patides pel treballador com a conseq\u00fc\u00e8ncia de la feina que desenvolupi.<\/p>\n<p>En el concepte d&#039;accident de tipus laboral s&#039;hi inclouen tamb\u00e9 els soferts per treballadors aut\u00f2noms, sempre que aquests hagin sol\u00b7licitat aquesta cobertura a la Seguretat Social i abonin les quotes socials corresponents, cobertura molt poc utilitzada.<\/p>\n<p>Per tant, perqu\u00e8 un accident sigui considerat laboral, i com a conseq\u00fc\u00e8ncia susceptible d&#039;indemnitzaci\u00f3, ha de complir les caracter\u00edstiques seg\u00fcents:<br \/>\n\u2022 Que el treballador pateixi una lesi\u00f3 corporal, f\u00edsica, ps\u00edquica o malaltia.<br \/>\n\u2022 Que sigui un treballador per compte ali\u00e8 o estigui donat d&#039;alta a la conting\u00e8ncia d&#039;accident de treball com a aut\u00f2nom per compte propi o sigui soci treballador d&#039;una societat mercantil.<br \/>\n\u2022 Que l&#039;accident sigui amb ocasi\u00f3 o com a conseq\u00fc\u00e8ncia de la feina.<\/p>\n<p>\u00danicament es podr\u00e0 reclamar indemnitzaci\u00f3 en cas d&#039;accidents professionals i laborals quan aquest s&#039;hagi produ\u00eft per culpa o neglig\u00e8ncia de l&#039;empresari en el compliment de les mesures de seguretat i salut a la feina, \u00e9s a dir, quan l&#039;accident sigui conseq\u00fc\u00e8ncia d&#039;una infracci\u00f3 de l&#039;empresari.<\/p>\n<p>A l&#039;hora de sol\u00b7licitar una indemnitzaci\u00f3 per accident laboral \u00e9s important reunir a la documentaci\u00f3 els resultats de les Inspeccions de Treball anteriors a la data de l&#039;accident per si s&#039;hagu\u00e9s aixecat un Acta d&#039;Infracci\u00f3, cosa que facilitaria el resultat positiu del litigi, aix\u00ed com tots els testimonis i documents que puguem.<\/p>\n<p>En cas d&#039;accidents molt greus, la policia aixecar\u00e0 atestat del que va passar.<\/p>\n<p>El responsable de pagament en cas d&#039;un accident patit a la feina (o In Itinere) ser\u00e0 l&#039;Empresa culpable de l&#039;accident i la seva Entitat Asseguradora (M\u00fatua) de la responsabilitat civil.<\/p>\n<p>En cas que hi hagi dues empreses responsables de l&#039;accident, contracta i principal per exemple, en la majoria dels casos totes dues seran responsables solidaris.<\/p>\n<p>La gran majoria de les empreses compten amb una asseguran\u00e7a de responsabilitat civil, per la qual cosa despr\u00e9s d&#039;identificar la companyia asseguradora, hem d&#039;ampliar la demanda contra ella (Jurisdicci\u00f3 Social) o ser citada com a responsable civil subsidiari (Jurisdicci\u00f3 Penal).<\/p>\n<p>Termini de prescripci\u00f3 dels accidents laborals, Com a norma general podem assenyalar que el termini de prescripci\u00f3 de l&#039;acci\u00f3 penal \u00e9s de 3 anys, mentre que en el cas de l&#039;acci\u00f3 social, aquest termini es redueix a 1 any a partir de l&#039;estabilitzaci\u00f3 de les seq\u00fceles, o si escau, a partir que sigui concedida la Incapacitat Permanent.<\/p>\n<p>Accidents laborals. A la legislaci\u00f3 espanyola es consideren accidents professionals els seg\u00fcents:<br \/>\n\u2022 Els accidents in itinere s\u00f3n considerats accidents laborals sempre que es produeixin en un recorregut directe entre el domicili habitual i el lloc de treball o viceversa (tal com ja expliquem)<br \/>\n\u2022 Els accidents de treball o professionals, inclosos els in itinere, ocorreguts com a conseq\u00fc\u00e8ncia de l&#039;exercici de c\u00e0rrecs electius o car\u00e0cter sindical o de govern d&#039;entitats gestores.<br \/>\n\u2022 Tots els accidents que es produeixin com a conseq\u00fc\u00e8ncia de les tasques executades pel treballador en inter\u00e8s del bon funcionament de l&#039;empresa en compliment de les ordres de l&#039;empresari, encara que siguin diferents de les establertes a la seva categoria professional.<br \/>\n\u2022 Els ocorreguts en actes de salvament o de naturalesa similar quan tinguin connexi\u00f3 amb la feina.<br \/>\n\u2022 Aquelles malalties, no catalogades com a malaltia professional, que es contreguin com a conseq\u00fc\u00e8ncia de la realitzaci\u00f3 de la tasca professional.<br \/>\n\u2022 Les malalties o defectes, fins i tot patides amb anterioritat a l&#039;accident, que s&#039;agreugin com a conseq\u00fc\u00e8ncia d&#039;aquest.<br \/>\n\u2022 Les malalties cardiovasculars, hemorr\u00e0gies cerebrals o similars quan es produeixen com a conseq\u00fc\u00e8ncia del treball.<\/p>\n<p>D&#039;altra banda, no estan considerats com a accidents de tipus laboral les excepcions seg\u00fcents:<br \/>\n\u2022 La imprud\u00e8ncia temer\u00e0ria i la imprud\u00e8ncia professional.<br \/>\n\u2022 Els produ\u00efts mentre l&#039;accidentat cometi un acte dol\u00f3s.<br \/>\n\u2022 Les malalties cardiovasculars hemorr\u00e0gies cerebrals o similars que tot i produir-se al lloc de treball, no s\u00f3n conseq\u00fc\u00e8ncia de l&#039;activitat professional, encara que sobre aquestes causes hi ha jurisprud\u00e8ncia contradict\u00f2ria.<\/p>\n<p>Com ja hem comentat a l&#039;ep\u00edgraf anterior, nom\u00e9s els accidents professionals conseq\u00fc\u00e8ncia d&#039;una infracci\u00f3 a les normes de prevenci\u00f3 de riscos laborals s\u00f3n susceptibles d&#039;indemnitzaci\u00f3.<\/p>\n<p>A continuaci\u00f3 us detallem les infraccions m\u00e9s habituals en els accidents en l&#039;exercici d&#039;una feina patida al nostre pa\u00eds:<br \/>\n\u2022 Manca d&#039;avaluaci\u00f3 dels riscos laborals dels llocs de treball dels treballadors.<br \/>\n\u2022 Manca de Mesures Col\u00b7lectives de Seguretat, (xarxes, baranes\u2026).<br \/>\n\u2022 Manca d&#039;Equips de Protecci\u00f3 Individual (EPI&#039;s) com ara arnesos, botes, guants, etc.<br \/>\n\u2022 Deficient coordinaci\u00f3 entre les diferents empreses que intervenen en un mateix projecte.<br \/>\n\u2022 Manca de delimitaci\u00f3 ni senyalitzaci\u00f3 de la zona de treball.<br \/>\n\u2022 Manca de Pla de Seguretat i Salut en el Treball amb contingut adequat als riscos per a la seguretat dels treballadors.<br \/>\n\u2022 Manca de formaci\u00f3 del treballador en Prevenci\u00f3 de Riscos Laborals.<\/p>\n<p>Si vols saber m\u00e9s sobre <a href=\"http:\/\/aranconsulting.cat\/ca\/algunes-consideracions-accidents-laborals\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>ALGUNES CONSIDERACIONS SOBRE ACCIDENTS LABORALS<\/strong><\/a> no deixis de consultar-nos:<\/p>\n<figure id=\"attachment_952\" aria-describedby=\"caption-attachment-952\" style=\"width: 300px\" class=\"wp-caption alignleft\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-952 size-medium\" title=\"http:\/\/aranconsulting.cat\/algunas-consideraciones-accidentes-laborales\/\" src=\"http:\/\/aranconsulting.cat\/wp-content\/uploads\/2015\/08\/cropped-Logo-ARAN-1-150x150-300x300.jpg\" alt=\"algunes-consideracions-accidents-laborals\" width=\"300\" height=\"300\" \/><figcaption id=\"caption-attachment-952\" class=\"wp-caption-text\">algunes-consideracions-accidents-laborals<\/figcaption><\/figure>\n<p>ARAN CONSULTING: ADVOCATS CONSULTORS<br \/>\nC\/ BORRES N\u00b0 66 BJOS, 08208, Sabadell \u2013 Barcelona<br \/>\nContacte telef\u00f2nic: 93 727 76 37<\/p>","protected":false},"excerpt":{"rendered":"<p>ALGUNAS CONSIDERACIONES SOBRE ACCIDENTES LABORALES Se denomina accidente laboral a aquel que sufre un trabajador durante su jornada laboral.
